This page outlines the terms and conditions governing your use of our online services and the website associated with our Service (collectively, the “Service“). By accessing or using the Service, or by clicking a button or checking a box indicating your agreement, you signify that you have read, understood, and agree to be bound by these Terms of Service (this “Agreement“), regardless of whether you are a registered user of our Service. Users of our Service must also agree to our Acceptable Use Policy. RemoteGenies reserves the right to modify these terms and will provide notice of any changes as described below. This Agreement applies to all visitors, users, and others who access the Service (“Users“). THIS AGREEMENT CONTAINS A MANDATORY INDIVIDUAL ARBITRATION PROVISION IN SECTION 10.2 (THE “ARBITRATION AGREEMENT”) AND CLASS ACTION/JURY TRIAL WAIVER PROVISION IN SECTION 10.3 (THE “CLASS ACTION/JURY TRIAL WAIVER”) THAT REQUIRE, UNLESS YOU OPT OUT PURSUANT TO THE INSTRUCTIONS IN SECTION 10.2, THE EXCLUSIVE USE OF FINAL AND BINDING ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES BETWEEN YOU AND US, INCLUDING ANY CLAIMS THAT AROSE OR WERE ASSERTED BEFORE YOU AGREED TO THESE TERMS. RemoteGenies provides a platform that allows users of the RemoteGenies Service to schedule and arrange the fulfillment of various services (“Requests”) through providers of such services (“Assistants”). RemoteGenies strives to ensure that its website is accessible to all individuals interested in its Service and in compliance with the standards established by the World Wide Web Consortium and applicable law. 1.1 Eligibility

This is a legal agreement between you and RemoteGenies. Before using the RemoteGenies Service, you must read and agree to these terms. If you do not agree, you may not use the Service. You may use the Service only if you can enter into a legally binding contract with RemoteGenies and comply with this Agreement and all applicable laws, rules, and regulations. The Service is not available to individuals under the age of 13 (or under 16 in Europe) and is strictly prohibited for such individuals. The Service is also not available to Users who have been previously removed from the Service by RemoteGenies. Certain Requests may not be available for users under 18 or 21 years of age, as applicable. In certain instances, RemoteGenies may require you to provide proof of identity to create your account or to access or use the Service. You acknowledge and agree that you may be denied access to or use of the Service if you refuse to provide such proof.

1.2 Limited License

Subject to the terms and conditions of this Agreement, you are granted a limited, non-exclusive, non-transferable, and revocable license to use the Service as permitted by its features. RemoteGenies reserves all rights not expressly granted herein in the Service and the content provided by RemoteGenies (the “RemoteGenies Content”). RemoteGenies may terminate this license at any time for any reason or no reason.

1.3 User Accounts

Your User Account on the Service grants you access to the features and services that we establish and maintain at our sole discretion. Different types of User Accounts may be available for different types of Users. If you create a User Account on behalf of a company, organization, or other entity, you represent and warrant that you are authorized to bind the entity to this Agreement and agree to this Agreement on the entity’s behalf. By connecting to RemoteGenies with a third-party service, you grant us permission to access and use your information from that service as permitted by that service, and to store your login credentials for that service. You must not use another User’s User Account without permission. When creating your User Account, you must provide accurate and complete information and keep it up to date. Failure to maintain accurate and complete account information may result in the inability to access and use the Service or termination of this Agreement by RemoteGenies. You are solely responsible for the activity that occurs on your User Account and must keep your User Account password secure. Please use strong passwords (combinations of upper and lowercase letters, numbers, and symbols) for your User Account. You must promptly notify RemoteGenies of any security breach or unauthorized use of your User Account. RemoteGenies will not be liable for any losses caused by unauthorized use of your User Account. By providing RemoteGenies with your email address, you consent to receiving Service-related notices via email, including any notices required by law, instead of communication by postal mail. We may also send you other messages, such as updates to the Service features and special offers, to the email address provided. If you do not wish to receive such messages, you may opt out by emailing us at help@RemoteGenies.com. Please note that opting out may prevent you from receiving email messages regarding updates, improvements, or offers.

1.4 Service Rules

You agree not to engage in any prohibited activities, including but not limited to: copying, distributing, or disclosing any part of the Service without authorization; using automated systems to access the Service in a manner that exceeds normal human usage; transmitting spam or unsolicited messages; attempting to compromise the integrity or security of the Service; taking actions that impose an unreasonable or disproportionately large load on the infrastructure; uploading viruses or other harmful software; collecting personally identifiable information from the Service; using the Service for commercial solicitation purposes; impersonating another person or entity; interfering with the proper functioning of the Service; accessing content on the Service through unauthorized means; or bypassing measures implemented to prevent or restrict access to the Service. 1.6 Disputes with Other Users

You are solely responsible for your interactions with other Users. RemoteGenies reserves the right, but has no obligation, to monitor disputes between you and other Users. RemoteGenies shall not be liable for any interactions with other Users or for the actions or inactions of any User.

1.7 Service Contracts and Direct Contracts

At RemoteGenies, Users are responsible for evaluating and entering into agreements with other Users, determining the terms of those agreements. It is important to note that Service Contracts establish a direct relationship between Clients and Freelancers, and RemoteGenies is not a party to such contracts.

Users have the flexibility to include additional agreements in their Service Contracts, as long as they do not conflict with RemoteGenies’ rights and obligations outlined in the Terms of Service. Optional Service Contract Terms are available for adoption, but Users should consider their applicability and seek legal advice if needed.

By following these guidelines, RemoteGenies promotes transparency and legal compliance in our community.

1.8 Exclusive Use of RemoteGenies for Payments

To ensure transparency and maintain the integrity of the RemoteGenies platform, you agree to utilize RemoteGenies as the sole method for making payments related to work originating from your RemoteGenies relationships. This requirement applies for a period of two years from the start of the relationship. Kindly note that a fee will be charged if you opt to conduct the relationship outside of the platform during this period.

1.9 Communication through RemoteGenies

Effective communication is vital for successful collaboration. Therefore, prior to entering into a service contract, users on RemoteGenies must exclusively communicate through our platform. Sharing direct contact information or attempting to communicate outside of RemoteGenies’ designated communication services is strictly prohibited.

Any violation of these sections constitutes a material breach of our Terms of Service and may result in the permanent suspension of your account.
